North Carolina courts may order one spouse (the “supporting spouse”) to pay support to the other spouse (the “dependent spouse”). The purpose of this support is to assist the dependent spouse with paying his or her reasonable monthly expenses.
Spousal support takes two forms: post-separation support (also called “PSS”) and alimony. Post-separation support is temporary in nature and typically lasts only until the parties are divorced or an alimony order is entered. Alimony will typically last until the occurrence of a particular event, such as the death of a spouse or the remarriage of the dependent spouse, or a specific date.
When determining the amount and duration of spousal support, the court will consider several factors, including the parties’ respective incomes and earning capacities, the couple’s standard of living during the marriage, and any marital misconduct.
